Formal Legal Objection to 2025-2026 COVID-19 Vaccine Formula Authorization on Grounds of Regulatory Misclassification and Statutory Non-Compliance

The Committee is hereby notified that the undersigned has initiated proceedings via Citizen Petition (21 C.F.R. § 10.30) and judicial review concerning the misclassification of COVID-19 mRNA products under binding federal regulations. Reverse Transcription: Laboratory evidence confirms BNT162b2 mRNA reverse transcription into DNA in human liver cells (Aldén et al., Current Issues in Molecular Biology, 44:1115-1126, 2022), contradicting the presumption of integration impossibility used to justify exemption from genotoxicity testing.

IV. UNREASONABLE RISK DETERMINATION CREATES MANDATORY DUTY

FDA's 2020 Guidance for Gene Therapy Products explicitly acknowledges that administration to large populations constitutes an "unreasonable risk" requiring enhanced monitoring: "When gene therapy products are administered to a large number of subjects... we recommend that you monitor subjects for delayed adverse events for a 5-year minimum."

This creates a non-discretionary duty to implement clinical hold under 21 CFR § 312.42(b)(1)(i), which mandates such action when "[h]uman subjects are or would be exposed to an unreasonable and significant risk of illness or injury." As established in Industrial Union Dept. v. American Petroleum Institute, 448 U.S. 607, 655 (1980), "unreasonable risk" exists when the risk is "significant" and cannot be justified by administrative convenience.

V. POST-CHEVRON REVIEW STANDARD

Following Loper Bright Enterprises v. Raimondo, 601 U.S. ___ (2024), which overruled Chevron deference, courts must exercise "independent judgment" regarding regulatory compliance. Environmental Defense v. Duke Energy Corp., 549 U.S. 561, 574 (2007) establishes that regulatory definitions must focus on "functional characteristics rather than nominal designations."

VI. EXECUTIVE BRANCH ACKNOWLEDGMENTS

Defense Secretary Hegseth's April 2025 memorandum explicitly characterized COVID-19 vaccines as "experimental." HHS Secretary Kennedy questioned their risk-benefit profile. These determinations by principal officers constitute administrative recognition necessitating regulatory correction.

VII. COMMITTEE'S MANDATORY RECOMMENDATIONS

The Committee must:

Recommend against approval of the 2025-2026 formula absent proper gene therapy classification;
Recommend clinical hold pursuant to 21 CFR § 312.42(b)(1)(i);
Advise implementation of the 5-15 year monitoring required by FDA guidance.

Committee members face potential liability under Motor Vehicle Manufacturers v. State Farm, 463 U.S. 29, 43 (1983), wherein agency action is arbitrary if it "failed to consider an important aspect" or offered an explanation "counter to the evidence."

Distinguished members of VRBPAC, my name is Xylie Desiree, and I appear today on behalf of Interest of Justice, we have no conflicts of interest. We are here because you are the last line of defense for the American people. Today, I am putting you on notice: you have a legal, ethical, and personal duty to act.

We have exercised our legal rights under FOIA to demand the statutorily required informed consent reports from HHS and the Department of Defense. Our requests have been met with evasion and delay. The agencies refuse to answer basic questions, including what authority they claim to override 50 U.S.C. § 1520a, which prohibits experimentation on the U.S. population without informed consent. The government's own records prove the illegality of this program.

This program began with fundamental fraud. The Department of Defense claimed authority it never had to initiate Operation Warp Speed. Congress expressly prohibited non-consensual experimentation on Americans. Because DoD never had lawful authority, every subsequent authorization was built on this original illegality. Each new authorization is tainted and prohibited, making all subsequent authorizations unlawful.

These products are not conventional vaccines, but gene transfer technologies. Their mechanism delivers genetic material into human cells, causing endogenous production of foreign antigens. This is the definition of gene therapy under FDA's own regulations which carries an unreasonable risk in healthy people according to FDA guidance. The Department of Defense has admitted these products are experimental.

FDA and CDC data show that for Pfizer-BioNTech, death is the sixth most frequently reported adverse effect after 30 days. Death accounts for 1.29% of all reported adverse effects. The FDA has failed to investigate this clear safety signal, instead claiming "it may not be our own data." But it is your data, and it is your duty to act on it.

There is a glaring regulatory contradiction. The Department of Defense admits these products are experimental, yet FDA allows them to be treated as "not investigational" domestically while classifying them as experimental upon export. This regulatory sleight of hand enables ongoing use of products causing death at unreasonable rates.

The FDA is required by law to classify products by their mechanism of action. These are gene transfer technologies, not vaccines. Dr. Peter Marks claimed that gene therapy guidance does not apply. This is arbitrary, capricious, and contrary to law. Misclassification evades required safety standards and exposes the public to unreasonable risk

The evidence of harm is mounting: myocarditis, neurological injury, immune dysregulation. Under FDA's own rules, any product presenting unreasonable risk must be withdrawn from the market. Continued Emergency Use Authorization violates the Administrative Procedure Act and Food, Drug, and Cosmetic Act.

There is substantial evidence that manufacturers and federal agencies withheld critical safety and efficacy data, constituting fraud on the regulatory process. This vitiates any presumption of lawful authorization or immunity.

This conduct violates U.S. law and international norms, including the Nuremberg Code and Declaration of Helsinki, which prohibit non-consensual experimentation on human beings. These are real lives, families, and futures at stake.

You are now fully informed. The law is clear. The science is clear. Your duty is clear: recommend immediate suspension, reclassification by mechanism of action, and issuance of clinical holds.

The American people and Interest of Justice are counting on you to do what is right.

The U.S. Food and Drug Administration has just granted full approval to the Novavax COVID-19 injection—but only for very specific groups. This approval is restricted to adults aged 65 and older, or individuals 12 and up with an existing health condition that allegedly increases the risk of so-called “severe COVID-19.”

For the general population, it remains off-limits. That fact alone should raise questions.

Unlike Pfizer and Moderna’s mRNA products, Novavax uses a protein-based platform. The FDA delayed its decision for six weeks while reviewing additional safety data, particularly in light of ongoing concerns about post-injection heart inflammation.

Ultimately, the agency approved the shot but required the company to conduct further post-marketing studies. What that means is FDA is fully approving experiments. These experiments include studies into the risk of myocarditis and pericarditis, and whether repeated applications of gene therapy pretending to be vaccination in healthy adults has any benefit at all.

It is telling that even under the FDA’s current framework—one that assumes COVID-19 is a real virus requiring pharmaceutical prevention—Novavax is only considered safe or necessary for the most vulnerable populations. That doesn’t really suggest much confidence. It clearly suggests damage control.

FDA Move Toward Multiple Antigen and Variant Matching Rewriting the Variant Narrative

The FDA is also steering vaccine manufacturers to update their formulas to match specific so-called “variants.” For the 2024–2025 season, it has recommended targeting what it refers to as the JN.1 lineage, with a preference for a sublineage called KP.2. This guidance is based on surveillance data and immunogenicity studies—neither of which have been made transparent to the public, nor independently verified outside tightly controlled institutions.

The story goes like this: JN.1 is allegedly spreading. KP.2 is supposedly more “prevalent.”

Therefore, manufacturers are instructed to tailor their next round of shots to match it, even though the basis for this strategy—so-called viral evolution and variant matching—rests on molecular assumptions and computational models, not on isolated, purified viral entities. It’s basically fantasy land. WHERE is the virus in real life?

The FDA’s advisory committee voted unanimously in June 2024 to endorse a single-strain formula for the upcoming season. Just weeks later, the agency shifted its stance slightly, telling manufacturers to prefer KP.2 specifically. This is not science; this is reactive policymaking dressed in scientific language.

WHO Follows Suit

The World Health Organization, through its Technical Advisory Group on COVID-19 Vaccine Composition (TAG-CO-VAC), echoed the FDA’s recommendations. It too endorsed JN.1 and KP.2 as acceptable targets, urging manufacturers to update their products accordingly.

Again, this pseudo-scientific guidance presumes that SARS-CoV-2 is real and mutating in predictable ways that demand continuous pharmaceutical updates. It presumes that the public’s immune systems are helpless without these reforms. It presumes that repeated genetic or protein-based injections are safe. None of this has been proven beyond doubt. On the contrary, each round of data suppression, retraction, or deflection only deepens public mistrust & destroys the immune system.

Toward a Multi-Strain, Self-Amplifying Future

While the agencies claim they’re focused on monovalent formulations—that is, shots targeting a single strain—they’re already moving toward multivalent options, which could combine multiple antigens in one product.

If so-called variant diversity increases, they say, a broader injection might be necessary.

This reminds us of Matt Hancocks - RELEASE THE NEXT VARIANT!

Leaked messages seen by The Telegraph showed that in December 2020, Matt Hancock, the health secretary at the time, suggested that the Government “frighten the pants off everyone” to ensure strict Covid rules were adhered to.

At the same time, self-replicating or self-amplifying mRNA technologies are being quietly developed. These platforms don’t just deliver a synthetic sequence. They instruct the body to produce the toxic by design spike protein—or other genetically encoded materials—over time, potentially in unknown quantities.

Some scientists argue this effectively turns the body into a bioreactor no one can turn off, raising profound ethical and biological questions.

The Real Takeaway

Novavax’s limited approval is not a triumph. It’s a red flag. The only people being offered this product are those the FDA sees as most expendable—or most easily coerced.

The science behind variant matching remains completely unverified. It’s more APPROVED experimentation, a disgrace and a violation of Nuremberg Code!

The push for annual shots, reformulated in response to proprietary genetic surveillance, continues without any admission of risk or error.

In Costa Rica here they just announced YEARLY COVID “VACCINES” & of course they are already pre-purchased! This is a global problem.

This is not medicine or even a vaccine as we once knew it. It’s unproven science policy masquerading as public health.

With every new approval, the questions grow louder and yet fall on FDA’s deaf ears:

Where is the data?

Where is the transparency?

And why are regulators still pretending the science is settled?

The recent FDA announcement April 10 to phase out animal testing requirements has coincided with the Trump administration's fast-tracking of a self-amplifying mRNA vaccine for H5N1 bird flu, raising serious questions about the relationship between regulatory standards, medical ethics, and emerging vaccine technologies.

This situation occurs against the backdrop of Robert F. Kennedy Jr.'s appointment as Health and Human Services Secretary and should cause renewed debates about the Nuremberg Code's relevance to modern vaccine development.

FDA's Shift Away from Animal Testing and the Nuremberg Code's Requirements Is Sketchy Due To Heavy mRNA Investments Causing VAED’s

Vaccine Associated Enhanced Disease (VAED’s) - it’s a real risk!

The FDA announced a groundbreaking policy change on April 10, 2025 to phase out animal testing requirements for monoclonal antibodies and other drugs, replacing them with "New Approach Methodologies" (NAMs).

These alternative methods include AI-based computational models of toxicity, cell lines, and organoid toxicity testing in laboratory settings.

This represents a significant departure from decades of regulatory practice. It's a hard problem to solve because who wouldn't want to protect animals from experimentation? At the same time the NAMs only catch up to 60% of Vaccine Associated Enhanced Disease, only able to be assessed through animal studies.

To be clear, recent studies have shown that NAMs are severely limited in their ability to detect complex immunological phenomena such as Vaccine Associated Enhanced Disease (VAED). Traditional animal models allow researchers to observe how vaccines affect the entire immune system in a living organism over time, capturing delayed reactions and complex immune cascades that cellular and computational models cannot replicate. NAMs simply cannot model the intricate interplay between innate and adaptive immunity that occurs in a living body, particularly the subtle imbalances that can lead to immune enhancement following vaccination and subsequent infection.

Furthermore, the animal models' ability to demonstrate antibody-dependent enhancement (ADE) - where antibodies facilitate viral entry into cells - remains unmatched by any current NAM technology. This is especially concerning for self-amplifying mRNA vaccines, as their novel mode of action creates potentially unpredictable long-term effects that would be impossible to detect without extended animal studies.

The FDA's own internal documents acknowledge that NAMs can currently detect only about 60% of potential VAED issues maximum, compared to comprehensive animal studies, leaving a dangerous 40%+ gap in safety assessment.

Historically, the requirement that animals be used in research and testing to protect humans was formalized in the Nuremberg Code following World War II. Is it really outdated? The Code emerged from the trials of Nazi doctors who conducted non-consensual experiments on concentration camp prisoners, establishing medical experimentation without informed consent as a crime against humanity.

The third point of the Nuremberg Code specifically states that experiments "should be so designed and based on the results of animal experimentation and a knowledge of the natural history of the disease or other problem under study that the anticipated results will justify the performance of the experiment". This requirement has been a cornerstone of medical research ethics for over 75 years.

However, the FDA's new direction suggests that animal testing requirements may be "based on scientifically outdated principles," as some critics have argued. FDA Commissioner Martin A. Makary stated that the new approach "marks a paradigm shift in drug evaluation and holds promise to accelerate cures and meaningful treatments for Americans while reducing animal use".

Makarty is anti Nuremberg Code, obviously.

Apparently FDA Commissioner Martin A. Makary thinks animal studies are outdated scientifically, but unproven new models NAMs are scientifically principled and better for all. IoJ is not yet convinced because we just studied NAMs in great detail and even FDA recent documentation says they are insufficient in comparison to animal studies.

Trump Administration’s FDA Fast-Tracks Self-Amplifying mRNA Vaccine for H5N1

Against this backdrop of changing regulatory requirements, the Trump administration has just rejected Novavax authorization renewal, a single antigen non mRNA version of covid vaccine, and this is where RFK Jr said FDA is moving toward multiple antigen models.

“It is a single antigen vaccine. And for respiratory illnesses, the single antigen vaccines have never worked,” Kennedy said when asked by CBS’s chief medical correspondent, Jonathan LaPook, why the decision was delayed.

In addition to puzzling so called experts, Kennedy’s statement that single antigen vaccines could bode poorly for multiple Covid vaccines currently under review. They are made by Novavax, Moderna, and Pfizer, along with its partner BioNTech.

Beyond the pending Novavax approval, the FDA must in the coming weeks advise Covid vaccine manufacturers on how to update their shots for the 2025-2026 respiratory season. Guarantee they will tell Pfizer and Moderna to go the multiple antigen way, which includes self replicating mRNA.

At the same time as denying Novavax and stopping animal studies, FDA granted Fast Track designation to ARCT-2304, a self-amplifying mRNA (sa-mRNA) vaccine candidate developed by Arcturus Therapeutics targeting the H5N1 avian influenza virus.

This designation is meant to expedite the development and review of drugs that address serious conditions with unmet medical needs. Bird flu is a BIG DEAL to the FDA. In real life not so much…

The self-amplifying mRNA technology represents a significant alleged advancement beyond conventional mRNA vaccines used during the COVID-19 pandemic. Unlike traditional mRNA vaccines that simply instruct cells to produce a viral protein to trigger an immune response, sa-mRNA continues to replicate within cells, potentially amplifying the production of flu-fighting proteins.

The Biomedical Advanced Research and Development Authority (BARDA), which was instrumental in Operation Warp Speed during the first Trump administration, is spearheading the funding and acceleration of ARCT-2304. The technology aims to enhance immune responses with lower doses, but its novel approach has raised questions about potential long-term effects.

Understanding Self-Amplifying mRNA Technology - the SECOND REVOLUTION

Self-amplifying mRNA vaccines represent what some call a "second revolution" in mRNA vaccine technology. These vaccines contain the equipment needed for self-replication once they enter cells. Does it ever turn off? Do we know yet?

How Self-Amplifying mRNA Works

A self-amplifying mRNA shot contains not only the mRNA for the antigen of interest (such as a viral protein) but also mRNAs that get translated into replicase proteins. These replicase proteins then produce more of the mRNA species. As one researcher colorfully described it:

"Picture sending someone a sheet of paper with some important information on it, and then imagine that you've sent them a whole pile of copies of that sheet so they can distribute them. Now imagine sending them a bunch of sheets of material that can assemble themselves into a working photocopier and crank out more sheets when they do".

These saRNA vaccines are derived from the genomes of RNA viruses, particularly alphaviruses. The alphavirus genome contains two open reading frames (ORFs): one coding for viral replicase (Rep) and a second coding for viral structural proteins. In saRNA vaccines, the ORF coding for structural proteins is replaced by the gene of interest—typically the antigen against which immunity is desired.

Why They Say They Want Self-Amplifying Technology

Self-amplifying mRNA vaccines require much lower doses than conventional mRNA vaccines to obtain similar immune responses. This has been demonstrated in clinical trials, including a Phase 1 study of an srRNA-based rabies vaccine candidate that showed "class-leading safety and immunogenicity" across all dose levels tested.

The technology allows for amplification of the antigen coding mRNA sequence, making self-replicating vaccines potentially more advantageous in terms of significantly higher production of the target antigen from relatively low vaccine doses.

RFK Jr.'s Position on Vaccines and Multiple Antigen Approach

Robert F. Kennedy Jr., now serving as Secretary of Health and Human Services, has expressed views on vaccines that have drawn both support and criticism. During his confirmation hearings, Kennedy faced questioning about his previous anti-vaccine statements but maintained that he is "pro-safety" rather than "anti-vaccine".

Kennedy has shown particular interest in vaccine technologies and testing protocols. While he has endorsed vaccines like those for measles, he has simultaneously questioned their safety testing and durability of protection. At his confirmation hearing, he stated: "In my advocacy I have often disturbed the status quo by asking uncomfortable questions, and I'm not going to apologize for that".

While Kennedy has not specifically addressed the transition to multiple-antigen self-amplifying vaccines, his historical focus on vaccine safety and testing protocols suggests this would be an area of interest for his HHS leadership. He also said the FDA will be focusing more on multiple antigen vaccines.

Its hard to be considered anti vaccine when RFK Jr is out pushing self replicating mRNA and is moving FDA toward multiple antigen vaccines… He’s pro experimenting on humans obviously. These are literally risky experiments.

Concerns About Replacing Animal Studies with NAMs

The FDA's move to kick Nuremberg Code to the curb and replace animal testing with New Approach Methodologies raises questions about whether these alternatives can adequately detect potential adverse effects. While NAMs may offer certain advantages, some concerns have been raised about their ability to predict complex immunological phenomena.

One such concern relates to the duration of mRNA persistence in the body. A letter to the FDA cited a Cell article showing that spike protein and its mRNA remain present in the germinal centers of draining lymph nodes for up to 60 days after mRNA vaccination, which was "not supposed to happen." The letter argues that "the demonstration of vastly prolonged spike protein production has revealed that the dose of spike protein produced in vivo by mRNA vaccines is unpredictable".

Another concern involves the immune system's response to vaccination. The same letter noted that while 93% of unvaccinated controls produced detectable SARS-CoV-2 anti-nucleocapsid antibody after infection, only 40% of the vaccinated produced this antibody after infection, suggesting that "most of the vaccinated failed to mount the expected immune response".

Such observations raise questions about whether NAMs can accurately model complex immune responses, including potential phenomena like antibody-dependent enhancement (ADE) or vaccine-associated enhanced disease (VAED).

In particular, experts have raised concerns that NAMs are fundamentally incapable of detecting many types of VAED due to their isolated nature. While animal studies allow researchers to observe the entire spectrum of immune responses as they unfold over time, NAMs represent only simplified fragments of these complex systems. Internal FDA documents have acknowledged that current NAM technologies can only identify approximately 60% of potential VAED cases that traditional animal studies would catch.

FDA Announces Plan to Phase Out Animal Testing Requirement for Monoclonal Antibodies and Other Drugs

For Immediate Release:

April 10, 2025

Today, the U.S. Food and Drug Administration is taking a groundbreaking step to advance public health by replacing animal testing in the development of monoclonal antibody therapies and other drugs with more effective, human-relevant methods. The new approach is designed to improve drug safety and accelerate the evaluation process, while reducing animal experimentation, lowering research and development (R&D) costs, and ultimately, drug prices.
The FDA’s animal testing requirement will be reduced, refined, or potentially replaced using a range of approaches, including AI-based computational models of toxicity and cell lines and organoid toxicity testing in a laboratory setting (so-called New Approach Methodologies or NAMs data). Implementation of the regimen will begin immediately for investigational new drug (IND) applications, where inclusion of NAMs data is encouraged, and is outlined in a roadmap also being released today. To make determinations of efficacy, the agency will also begin use pre-existing, real-world safety data from other countries, with comparable regulatory standards, where the drug has already been studied in humans.
“For too long, drug manufacturers have performed additional animal testing of drugs that have data in broad human use internationally. This initiative marks a paradigm shift in drug evaluation and holds promise to accelerate cures and meaningful treatments for Americans while reducing animal use,” said FDA Commissioner Martin A. Makary, M.D., M.P.H. “By leveraging AI-based computational modeling, human organ model-based lab testing, and real-world human data, we can get safer treatments to patients faster and more reliably, while also reducing R&D costs and drug prices. It is a win-win for public health and ethics.”
Key Benefits of Replacing Animal Testing in Monoclonal Antibody Safety Evaluation:

Advanced Computer Simulations: The roadmap encourages developers to leverage computer modeling and artificial intelligence to predict a drug’s behavior. For example, software models could simulate how a monoclonal antibody distributes through the human body and reliably predict side effects based on this distribution as well as the drug’s molecular composition. We believe this will drastically reduce the need for animal trials.
Human-Based Lab Models: The FDA will promote the use of lab-grown human “organoids” and organ-on-a-chip systems that mimic human organs – such as liver, heart, and immune organs – to test drug safety. These experiments can reveal toxic effects that could easily go undetected in animals, providing a more direct window into human responses.
Regulatory Incentives: The agency will work to update its guidelines to allow consideration of data from these new methods. Companies that submit strong safety data from non-animal tests may receive streamlined review, as the need for certain animal studies is eliminated, which would incentivize investment in modernized testing platforms.
Faster Drug Development: The use of these modern techniques should help speed up the drug development process, enabling monoclonal antibody therapies to reach patients more quickly without compromising safety.
Global Leadership in Regulatory Science: With this move, the FDA reaffirms its role as a global leader in modern regulatory science, setting new standards for the industry and encouraging the adoption of innovative, humane testing methods. In recent years, Congress and the scientific community have pressed for more human-relevant testing methods. Today’s announcement is a step by the FDA towards its commitment to modernize regulatory science as technology advances.

Working in close partnership with federal agencies such as the National Institutes of Health, the National Toxicology Program and the Department of Veterans Affairs, the FDA aims to accelerate the validation and adoption of these innovative methods through the Interagency Coordinating Committee on the Validation of Alternative Methods (ICCVAM). The FDA and federal partners will host a public workshop later this year to discuss the roadmap and gather stakeholder input on its implementation. Over the coming year, the FDA aims to launch a pilot program allowing select monoclonal antibody developers to use a primarily non-animal-based testing strategy, under close FDA consultation. Findings from an accompanying pilot study will inform broader policy changes and guidance updates expected to roll out in phases.
Commissioner Makary noted the far-reaching significance of this proposal. “For patients, it means a more efficient pipeline for novel treatments. It also means an added margin of safety, since human-based test systems may better predict real-world outcomes. For animal welfare, it represents a major step toward ending the use of laboratory animals in drug testing. Thousands of animals, including dogs and primates, could eventually be spared each year as these new methods take root.”

HHS Secretary Robert F. Kennedy Jr. just unveiled new reforms that could transform how this country treats vaccine injuries forever.

But before sharing the details with Chris Cuomo Thursday night, he exposed just how bad things really were inside the Department of Health and Human Services before he took charge.

According to Kennedy, parts of HHS were “selling patient information to each other” and actively working against one another.

That means your private health data—funded by taxpayers—was being treated like a commodity inside the same agency that’s supposed to protect it.

But it gets even worse. Kennedy said when he tried to access CMS data—patient and billing records from Medicare and Medicaid—he was told HHS would have to buy it back from another branch of itself.

“So I tried to get the CMS patient information, which belongs to the American people and belongs to HHS, and the sub-agencies said we have to buy it from them, and it doesn’t make any sense. There are sub-agencies that refuse to give us patient data,” Kennedy lamented.

This kind of red tape, he argued, is exactly what’s prevented progress. But change is already in motion.

Kennedy pointed to DOGE—the Department of Government Efficiency—as one of the major drivers of reform.

“We’re going from 82,000 workers to 62,000. That’s tough on everybody. But I think in the long run we’re going to have much greater morale in a demoralized agency,” he said.

The vaccine injury news broke when Kennedy announced that the CDC is creating a new sub-agency focused entirely on vaccine injuries—a long-overdue shift for patients who’ve spent years searching for answers without any support from the government.

“We’re incorporating an agency within CDC that is going to specialize in vaccine injuries,” Kennedy announced.

“These are priorities for the American people. More and more people are suffering from these injuries, and we are committed to having gold-standard science make sure that we can figure out what the treatments are and that we can deliver the best treatments possible to the American people.”

For years, the vaccine-injured have felt ignored or dismissed, as public health agencies refused to even acknowledge the problem. Now, there’s finally an initiative underway to investigate their injuries and to provide support.

Kennedy also revealed a series of additional HHS reforms aimed at turning America’s health crisis around:

1. Operation Stork Speed

“We launched Operation Stork Speed to improve our capacity to have good, nutritious baby formula for the American public that doesn’t have heavy metals or other poisons in it,” Kennedy explained.

2. Eliminating Toxic Food Dyes

“We’ve met with the major food processors and told them we want chemical dyes out of all of our foods,” he added.

3. Cleaning up the SNAP program

Kennedy also pointed out that a huge portion of government food aid is going toward sugar-filled sodas—and it’s fueling a health crisis.

“Ten percent of SNAP is now spent on soda drinks, which are giving diabetes to children… 38% of American teens are now prediabetic or diabetic,” he lamented.

“We are reforming the SNAP program so that we’re not poisoning kids.”

The ultimate goal, Kennedy said, is to restore America’s health to what it was when he was a kid—before toxic food dyes, ultra-processed foods, and an out-of-control 72-dose vaccine schedule entered the picture.

“We’re reforming every part of the agency to make sure that our food supply is good and that we have the healthiest kids in the world, which we had when I was a kid.”

Whether you agree with him or not, Kennedy is doing more at HHS than any leader in recent memory—and for the first time in a long time, Americans injured by vaccines are finally being heard.

RFK Jr is NOT going to stop the shots anytime soon. He will need to investigate injuries and only then could he do it. To answer these questions we will begin with a series of clarifications and background information that we consider necessary to clarify the doubts raised since it has been seen that due to the rapid development of COVID-19 vaccines and their early approval has raised concerns among some people about whether all safety and efficacy standards for the vaccines have been met. We begin by clarifying the research phases of the vaccines and a bit about the approval process for vaccines by the FDA and EMA, which are founding members of the International Council on Harmonization of Technical Requirements for Pharmaceutical Substances for Human Use and meet the definition of WHO Strict Regulatory Authority (available at https://www.who.int/initiatives/who-listed-authority-reg-authorities/SRAs ).

The phases of vaccine development and the different research studies that prioritize the safety of use of a vaccine and its efficacy (information taken from the World Health Organization website, available at https://www.paho.org/es/documentos/covid-19-fases-desarrollo-vacuna) are as follows:

• Preclinical phase: Experimental results on efficacy and tolerance in animal models support subsequent research in humans. Preclinical studies use tissue culture systems or cell cultures and tests on animals, which can be mice or monkeys, to evaluate the safety of the candidate vaccine and its immunogenicity, or ability to provoke an immune response.

• Phase I: This usually involves testing a new experimental vaccine in a small number of humans, usually fewer than 100 adults, with the aim of initially evaluating its safety and biological effects, including immunogenicity. This phase may include studies of dosage and routes of administration.

• Phase II: Testing a vaccine that was deemed safe in Phase I requires a larger group of humans (usually between 200 and 500) to monitor safety and also trials that will determine the vaccine's efficacy. The goals of Phase II trials are to study the candidate vaccine for safety, immunogenicity, proposed dosage, and method of administration.

• Phase III: These are intended to more fully evaluate safety and efficacy in preventing disease and involve a larger number of volunteers participating in a properly controlled, multi-center study. They may include hundreds to thousands of humans in one or more countries. Phase III trials are randomized and double-blind, and involve the candidate vaccine being tested against a placebo (the placebo may be saline, a vaccine for another disease, or some other substance). This is generally the step prior to a vaccine being approved.

• Phase IV: These are studies that occur after a vaccine has been approved in one or more countries. These studies aim to evaluate how the vaccine works in the “real world.” In general, these are effectiveness studies and they also continue to monitor adverse events.

When the World Health Organization (WHO) elevated the public health emergency situation caused by COVID-19 to an international pandemic on March 11, 2020, given the rapidity of the evolution of events, it caused health authorities at the national and international level to adopt immediate and effective measures to deal with these extraordinary circumstances of an unprecedented health crisis of enormous magnitude, both due to the very high number of people affected and the extraordinary risk to their lives and rights.

The different regulatory authorities for products of health interest around the world implemented existing national mechanisms or began to develop special mechanisms to address this global state of emergency and allow access to diagnostic tests, medical devices and medicines to treat COVID-19 disease that have demonstrated a quality, safety and efficacy profile appropriate for human use.

For these purposes, the FDA has the figure of Emergency Use Authorization (EUA), which as described on the FDA website (available at: https://www.fda.gov/vaccines-blood-biologics/vaccines/explanation-of-the-emergency-use-authorization-for-vaccines ), is a mechanism to facilitate the availability and use of medical countermeasures, including vaccines, during public health emergencies, such as the current COVID-19 pandemic. Under an EUA, the FDA may allow the use of unapproved medical products, or unapproved uses of approved medical products in an emergency to diagnose, treat, or prevent serious or life-threatening diseases or conditions, when certain regulatory criteria have been met, including that there are no adequate, approved, and available alternatives. Based on input from the FDA, manufacturers decide whether and when to submit an EUA request to the FDA.

Taking into account the above, in the case of most COVID-19 vaccines, they began as new investigational vaccines (or vaccine candidates), which passed preclinical studies to begin their use in clinical research in phase I, II, III studies and could only be used within the framework of clinical studies.

When Phase II/III or Phase III studies of the experimental vaccine begin to show positive safety and efficacy results with at least 2 months of follow-up after the application of the complete vaccination schedule, the FDA's Emergency Use Authorization (EUA) can be requested (the guide is available at: https://www.fda.gov/regulatory-information/search-fda-guidance-documents/emergency-use-authorization-vaccines-prevent-covid-19 ). The FDA may issue an EUA when certain criteria are met, which this includes the absence of acceptable, approved, and available alternatives. In addition, the FDA's decision is based on the totality of available scientific evidence showing that the product may be effective in preventing COVID-19 during the COVID-19 pandemic and that the known and potential benefits of the product outweigh its known and potential risks (adverse effects). This allows for widespread use of the vaccine, not just in clinical trials like experimental vaccines, and is generally in effect as long as emergency use of the vaccine is justified. This was the case with the Pfizer-BioNTech vaccine.

In the case of formal approval or authorization of a vaccine by the FDA, it is required that all quality information, nonclinical studies and phase I, II and III clinical studies with at least 6 months of follow-up after the completion of the proposed vaccine regimen be submitted. And if after the analysis of the information, a balance of the risks and benefits of the use of the drug is made for the authorization of the drug. This is why the FDA authorization for the Pfizer-BioNTech vaccine was only authorized for the vaccination of those over 16 years of age since they are the only studies that have completed 6 months of follow-up, vaccination in adolescents from 12 to 15 years of age and the one recently approved in children from 5 to 11 years of age is under the figure of emergency use authorization, since as previously clarified for formal authorization in these populations, a 6-month follow-up is required (information from the Fact Sheet for Recipients and Caregivers on the Pfizer-BioNTech COVID-19 Vaccine available at: https://www.fda.gov/emergency-preparedness-and-response/coronavirus-disease-2019-covid-19/comirnaty-and-pfizer-biontech-covid-19-vaccine#translated).

The emergency use authorization supports the evaluation of all the information that these are quality, safe and effective vaccines to prevent a disease for which there is currently no other approved effective therapeutic option.

And, just as the FDA in the United States is considered a Strict Regulatory Authority by the WHO, so is the European Union agency, the European Medicines Agency (EMA), which since December 21 granted authorization to the Pfizer-BioNTech COVID-19 vaccine, and on January 29, 2021 approved the AstraZeneca COVID-19 Vaccine, not under the Emergency Use Authorization figure, in this case EMA used the "rolling review" process, which is an exceptional mechanism by which the authority evaluates the data as it comes in, and since the information is complete and robust enough to reach a conclusion about the quality, safety and efficacy of the vaccine, conditional authorization was granted.

As explained in different EMA communications and I quote the following communication from the Spanish Agency for Medicines and Health Products (AEMPS): “EMA's conditional marketing authorization is an instrument contemplated in European legislation that allows an authorization in the event of an unmet medical need, to the extent that the benefit to public health of its immediate availability is greater than the uncertainty derived from the limitation of the available data.

This type of authorization is not specific to this situation; it has been granted outside and within the pandemic and requires more data than an authorization for emergency situations such as the one granted (available in Others regions “regulatory”

Once conditional authorisation’s have been granted, they can be marketed in all member states of the European Union, as is the case with all authorised medicines; only in this case, the COVID-19 vaccines have not been able to be marketed at the national level. private pharmacies, because the production of these vaccines is still compromised to comply with the marketing agreements that the laboratories made with the different governments for national vaccination campaigns.

It is then up to the authorities of each country to authorize or not the use of each vaccine in their jurisdictions and to develop policies for administering them, based on WHO recommendations.

In the case of Costa Rica, article 117 of the General Health Law indicates that: The Ministry of Health, the Costa Rican Social Security Fund and any other state entity, with public health or social security functions, may acquire unregistered medicines, at any time or under any circumstances. In case of urgency or public need, the Ministry may authorize the importation of unregistered medicines. Thus, by declaring, through Executive Decree No. 42227 - MP - S, of March 16, 2020, the stat of national emergency throughout the territory of the Republic of Costa Rica, due to the health emergency situation caused by the disease caused by COVID-19, both the CCSS and any other state entity may import COVID-19 vaccines without health registration.

However, since these are vaccines that would be used for the first time in humans, and to ensure the population rapid access to vaccines and safeguard the health of the Costa Rican population, the National Vaccination and Epidemiology a Strict Regulatory Authority or approved in the List of Use ofWHO Emergency, so we made sure that the expert committees of these authorities that have quite strict regulations and robust regulatory processes, reviewed the information and gave their recommendation and Costa Rica would provide an authorization based on the recognition made by these Strict Regulatory Authorities as described in administrative resolution DM-RM-7905-2020 of December 3,2020.

By having a current registration with the Ministry of Health, we can ensure that said vaccines met the requirements established by the Technical Regulation: RTCR 440: 2010. Regulations for the Registration and Control of Biological Medicines, Executive Decree No. 37006-S in force and the Central American Technical Regulation RTCA 11.03.59:18 Pharmaceutical Products. Medicines for Human Use. Sanitary Registration Requirements Executive Decree No. 43259-COMEX-S-MEIC and, therefore, they presented the complete preclinical studies and the certificates of compliance with Good Manufacturing Practices, as well as all the quality information of the vaccine production process and quality verification, which refers to questions 1 and 2 of your consultation.

However, much of the technical and scientific information supporting the quality of this vaccine, as with other medicines, is protected by the Undisclosed Information Act, Law No. 7975 of January 4, 2000, and cannot be shared without the express authorization of the holders of said information. Louisiana’s Department of Health (LDH) “will no longer promote mass vaccination” according to a memo sent out by the state’s top health official on Thursday shortly after vaccine sceptic Robert F Kennedy Jr was confirmed by the Senate as Donald Trump’s new Health and Human Services Secretary.

In the memo addressed to all “LDH Team Members”, the southern state’s Surgeon General Ralph Abraham, former Republican congressman, ordered his staff to stop engaging with media campaigns and community efforts to encourage vaccinations, despite Louisiana recently suffering a particularly harsh flu season.

“The State of Louisiana and LDH have historically promoted vaccines for vaccine preventable illnesses through our parish health units, community health fairs, partnerships and media campaigns,” Abraham wrote, according to a copy of the memo obtained by CNN.

“While we encourage each patient to discuss the risks and benefits of vaccination with their provider, LDH will no longer promote mass vaccination.”

Abraham also urged healthcare providers to treat vaccines with “nuance”, stressing the distinction between “seasonal vaccines and childhood immunizations.”

In a separate letter posted on the department’s website, he went on to denounce “blanket government mandates” for vaccines and criticized the Centers for Disease Control and Prevention (CDC)’s Covid-19 vaccination push, arguing that individual citizens should be free to make their own healthcare decisions and labelling the federal pandemic response “an offense against personal autonomy that will take years to overcome.”
“Government should admit the limitations of its role in people’s lives and pull back its tentacles from the practice of medicine,” Abraham wrote, adding that his department will nevertheless continue to stock vaccines and make them available to the public upon request.

THE PUSHBACK:

His directive has already drawn an adverse reaction, with Jennifer Herricks of Louisiana Families for Vaccines warning that the surgeon general’s actions will lead to an increase in preventable illnesses and deaths.

“We are very concerned for people in Louisiana who have historically depended on vaccination drives to get easily accessible vaccines that are no longer going to be available,” Herricks said.

New Orleans City Council responded on Thursday by passing a resolution pledging to continue supporting vaccination efforts, stressing that it is not bound by the instruction.

Jennifer Avegno, the city’s Health Department Director, said state-supported efforts have led thousands of people to receive vaccines in the past.

Like Herricks, she said she anticipates vaccination rates for preventable diseases to drop as a consequence of Abraham’s new policy, warned of the likely spread of misinformation and pointed out that vaccines are most effective when their use is widespread.

“Public health is really united on this issue: For more than a century, vaccines of all kinds have been a cornerstone of improving public health in America,” Avegno told the council.

“There’s no scientific debate on this, this is as close as you can get to established fact that vaccinations, particularly mass vaccinations, and community immunity, saves millions and millions of lives.”

Speaking subsequently to CNN, Avegno continued: “When you deprioritize, when you create confusion and doubt to any kind of medical information, then the fact is that folks don’t get it.

“We’re already seeing that; our childhood vaccination rate has dropped in the last year or so, like many other states in the country.

Asked about the timing of Abraham’s announcement coinciding with Kennedy’s confirmation in Washington, Avengo said she did not believe it was a coincidence.

“Now they have, in the ultimate health authority in America, someone who has been a champion of the same falsehoods that have been promulgated locally,” she said.

Dr Robert Collins, a Dillard University political analyst, told Fox 8 that he believed Abraham’s memo was entirely politically-motivated.

“What we’re seeing here is the Louisiana State Government under the direction of Governor [Jeff] Landry basically just trying to come in compliance with what they consider current Trump rules to be under the federal government’s guidelines,” he said.

“Even though Dr Abraham is a practicing physician, in his past life he was also a former congressman, he has deep ties to the Republican Party.

Nature of the Dispute:

This international legal dispute arises from the alleged widespread misuse of products authorized under the World Health Organization’s (WHO) Emergency Use Listing (EUL) mechanism, which allowed the procurement, distribution, and administration of investigational vaccines without adequate informed consent regarding known risks to life and health. Interest of Justice alleges that the WHO, along with the governments of Costa Rica, the United States, UK and many Member State countries seriously breached their obligations under international and national laws by integrating these unproven interventions into national vaccine schedules, leading to harm to individuals’ lives and health.

Parties Involved:

Interest of Justice: The Claimant, a civil society international organization dedicated to protecting human rights and holding international organizations with their Member States accountable for unlawful conduct.
World Health Organization (WHO): The wrongdoer, accused of authorizing the procurement and use of investigational vaccines under the Emergency Use Listing procedure without ensuring adequate safety standards, informed consent, or transparency in disclosing known risks.
Government of Costa Rica: The wrongdoer, accused of violating its own biomedical research laws by signing procurement contracts for EUL-authorized vaccines without ensuring proper informed consent and without complying with legal requirements for safety guarantees in public health interventions.
Government of the United States: The wrongdoer, accused of participating in the global distribution and administration of investigational vaccines without properly informing citizens of the risks involved in receiving such vaccines under the EUL, leading to serious harm.

Statement of Facts:

WHO Authorization of Unproven Interventions: The WHO, through its Emergency Use Listing (EUL) procedure, authorized the use of investigational vaccines during the global pandemic. These vaccines, developed and distributed without full approval or comprehensive safety trials, were integrated into national vaccine schedules by countries such as Costa Rica and the United States.
Waiver of Good Manufacturing Inspections and Safety Standards: Under the EUL mechanism, and "regulatory flexibility" WHO waived many of the good manufacturing inspections and safety protocols that would typically apply to vaccines. This waiver led to the distribution of vaccines that had not undergone sufficient testing to establish their long-term safety or efficacy.
Lack of Informed Consent: Costa Rica, the United States and most WHO Member States integrated the WHO-authorized vaccines into their national vaccine schedules without ensuring that citizens were properly informed of the experimental nature of the vaccines and the potential risks to life and health. Informed consent, a core requirement under international human rights law and national biomedical laws, was disregarded.
Serious Breaches of National and International Law:
- In Costa Rica, and many Member States procurement contracts for the investigational vaccines were signed without compliance with national laws requiring insurance for vaccine-related injuries and without proper risk disclosure.
- In the United States, federal health authorities pushed for widespread use of EUL-authorized vaccines without providing the public with sufficient warnings about known risks, in breach of U.S. Food and Drug Administration (FDA) regulations and the Nuremberg Code’s principles regarding human experimentation.
Adverse Health Consequences: Many thousands, if not millions, of individuals in Costa Rica, the United States and globally suffered adverse health effects as a direct result of the widespread and systematic administration of these unproven vaccines. Reports of severe side effects, including life-threatening complications, have emerged, and many affected individuals claim they were not adequately informed of the risks prior to receiving the vaccines.

Legal Basis for the Claims:

Breach of International Law:
- Violation of the Right to Life and Health: The International Covenant on Civil and Political Rights (ICCPR), Siracusa Principles and the Universal Declaration of Human Rights guarantee the right to life and the right to health. By authorizing and distributing vaccines under the EUL without sufficient safety guarantees, the WHO, Costa Rica, the United States and most Member States violated these fundamental rights.
- Nuremberg Code Violations: The administration of investigational vaccines without informed consent constitutes a violation of the Nuremberg Code, which explicitly prohibits human experimentation without voluntary and informed consent. Costa Rica, the United States and most Member States administered these unproven vaccines without ensuring informed consent, thus breaching international legal standards.
Breach of National Laws:
- Costa Rican Biomedical Research Laws: Costa Rica’s national biomedical research regulations explicitly prohibit the procurement and use of investigational medical products without prior insurance for injuries and proper informed consent. By signing contracts and integrating EUL vaccines into its vaccine schedule, Costa Rica breached these laws, causing harm to its citizens.
- U.S. Food and Drug Administration (FDA) Regulations: The FDA’s regulatory framework mandates that any investigational medical product used under emergency conditions must be accompanied by full disclosure of the known risks. By failing to inform the public of the risks of the EUL vaccines, U.S. authorities violated these regulations and endangered public health.
Breach of WHO’s Own Standards:
- Failure to Ensure Safety: WHO's International Health Regulations (IHR) and internal guidelines require that all health interventions authorized for global use must comply with strict safety and efficacy standards. By waiving manufacturing inspections and distributing vaccines without adequate safety data, the WHO acted outside its mandate and violated its own obligations.
- Waiver of Immunity in Commercial Agreements: WHO has engaged in contractual agreements with vaccine manufacturers, governments, and other stakeholders under the EUL. These contracts of a commercial nature may require waivers of immunity, allowing WHO to be held accountable for failure to ensure product safety or for harm caused by their investigational interventions.

Relief Sought:

Damages: Interest of Justice seeks compensatory and punitive damages for serious delays in justice, and for individuals harmed by the investigational vaccines in Costa Rica and the United States, including compensation for medical expenses, loss of income, and pain and suffering.
Injunction: Interest of Justice seeks an injunction to halt the continued use of EUL-authorized vaccines in national vaccine schedules, and the WHO EUL Listing until they undergo full regulatory approval and safety testing in accordance with international and national legal standards.
Public Apology and Reparation: Interest of Justice demands a public apology owed erga omnes from WHO, Costa Rica, the United States and all wrongdoer Member States for their roles in exposing citizens to harmful investigational vaccines without adequate informed consent. The parties must establish a compensation fund for those affected by vaccine-related injuries and make provisions to compensate and cease censorship of medical and other opinion involving public health.
Revocation of EUL Authorization: Interest of Justice seeks the immediate revocation and GLOBAL DELISTING of WHO’s EUL for the mRNA vaccines & PCR in question, along with a full investigation into the breaches of safety and consent protocols.

Conclusion:

Interest of Justice contends that the WHO, Costa Rica, the United States and most Member States violated international human rights law, national biomedical laws, and the ethical standards governing public health interventions by authorizing and distributing investigational vaccines without adequate informed consent. These actions resulted in widespread harm and demand immediate legal redress. Interest of Justice urges the National Authorities to hold the WHO and wrongdoer Member State Countries accountable for their breaches and to ensure that no further harm to individuals or the public interest is caused by the continued use of unproven pandemic medical products.

Costa Rica stands at a critical juncture in its fight against the aggressive push for mass COVID vaccination, driven by the policies of former Health Minister Daniel Salas and backed by international organizations like the Pan American Health Organization (PAHO)—which is, in fact, the World Health Organization (WHO) for the Americas.

Under oath, Salas admitted that these alleged vaccines were imported as “investigational,” and regulated under Biomedical Research laws, confirming that they were experimental in nature in Costa Rica and not fully approved. Despite this, he continued to mandate their use for vulnerable segments of the population.

Two days after confessing to the Interest of Justice in writing, under oath, about the investigational status of the vaccines, Salas forced the experimental/investigational injection of a six-year-old child—against the desperate, screaming pleas of his pregnant mother. This incident represents a dark chapter in Costa Rica’s COVID response, highlighting how far Salas was willing to go to meet the WHO and PAHO’s 100% vaccination goal, he literally became the Mengele of the America’s, forcing a genetic experiment on a child, knowing it was potentially harmful and experimental, because he testified its “investigational”, a word meaning in law: “experimental”.

Salas’ early departure from his ministerial post to become the Head of Vaccines for the Americas for PAHO/WHO raises significant concerns about his motivations and the role of PAHO/WHO in influencing national health policies. He was recruited a week early for this influential position, leaving behind a country in turmoil, now facing a planned door-to-door vaccination campaign targeting every household that he ordered from on high at his new top post in PAHO. The fact that Salas’ mandate, and now Mary Munive’s, are based on PAHO recommendations underscores the connection between Costa Rica’s Health Ministers policies and the broader WHO agenda for the Americas. PAHO, acting as the WHO for the region, has been relentless in its push for total vaccination coverage, disregarding the investigational nature of the vaccines and the growing concerns about their safety.

This brings us to the most critical point: the upcoming hearing is our last chance to stop this overreach. The objective of the hearing is to hear our concerns for real data in order to revoke WHO Director-General Tedros Adhanom Ghebreyesus’ authorization of the Emergency Use Listings (EUL) for both the PCR tests and the COVID vaccines. It’s by far the most important hearing since the imaginary covid attack began.

To put it in perspective, these EUL authorizations are the ONLY legal foundation allowing PAHO and WHO to push these investigational vaccines across the Americas AND GLOBE. If the EUL is revoked by a Member State (because WHO refuses), it will effectively dismantle the PAHO/WHO global authority that is driving these dangerous vaccine policies.

Vice President and Minister of Health Mary Munive Ángel Müller, despite her calls for reform and better data, remains trapped under the influence of PAHO/WHO’s vaccine agenda. In her recent speech, she reiterated the need for a 100% vaccine rollout, following PAHO’s lead, while admitting that without accurate data, their efforts will fail.

This is our window of opportunity.

VP and Health Minister Mary Munive Müller emphasized the need for transparency and accountability, not just in the public health sector but across the entire healthcare landscape. “In troubled waters, fishermen gain,” she said, warning that corruption thrives when governance structures are weak.

Müller has given us a platform—a hearing to present the correct data—and fully acknowledged the truth that flawed data will undermine their entire strategy.

Now, it is up to us, assisted by Dr. Yeadon, Sasha Latypova, Dr. Janci Lindsay and other top experts to expose the inaccuracies driving the PAHO/WHO recommendations and stop the door-to-door vaccine sweeps that could soon become a reality.

We cannot underestimate the gravity of this situation. The planned door-to-door sweeps to pass out covid-19 so called vaccines like candy, backed by PAHO, represent an unprecedented invasion into the personal medical choices of Costa Rican families. Worse, these vaccines still remain investigational, while the regulator for investigational imports (CONIS) lies to us under oath that they are approved, and while the regulator for approved products insists they do not see it registered there, yet they are being pushed on children, babies, and vulnerable populations without proper informed consent. The forced vaccination of a six-year-old child under Salas’ watch is just one harrowing example of what can happen when a government, under international pressure, loses sight of its duty to protect its own people and allows their institutions to be penetrated by WEF and other economic hitmen such as the Big Pharma monopoly.

But there is hope. The Nuremberg Hearing to examine the toxicity of the shots and potentially revoke WHO’s EUL authorization is the only pathway that can stop PAHO/WHO from continuing to enforce these dangerous and coercive vaccine policies in Costa Rica, across the Americas and across the entire globe.

WHO & PAHO’s power to mandate vaccines hinges entirely on WHO’s emergency use listings, and if we succeed in revoking them, we can halt the overreach of these global organizations worldwide and save humanity from the scourge of experimental interventions.

We must act now. The opportunity to present accurate, scientific data at this hearing with top experts like Dr. Yeadon is a rare chance to be heard on the concerns we have had for years, and to stop the tide of forced vaccinations and protect the health and rights of every Costa Rican citizen and potentially across the globe.

This is not just a fight for Costa Rica—it is a fight against the global machinery of PAHO and WHO, which seeks to pressure countries to impose investigational (experimental) vaccines on entire populations without proper oversight or regard for individual freedoms. This case and Nuremberg Hearing starting on 11-11 is for helping everyone!

The hearing starting 11-11, which will likely be a series of hearings, could be the turning point, but only if we make the most of it. Armed with the truth, we can dismantle the false narratives driving PAHO’s vaccine push, revoke the WHO’s EUL listings, and bring an end to the coercive vaccine mandates threatening Costa Rican families. Time is running out for us to raise the Attorney fees to have the best shot to win, but together, we can ensure that the rights and health of our people are protected and that this hearing is taken seriously.

The future of healthcare in Costa Rica—and indeed across the Americas, and entire globe—literally depends on the outcome of this hearing. The threat is real, but so is the hope for change.

COVID-19 - Flu Vaccine mixed and it’s not mRNA = Scientists from Australia are about to start the trials!

Here’s some high level propaganda from the Australia news:

Combination COVID-19/flu vaccines are being tested, with Moderna starting phase 3 trials

A combination COVID-19 and influenza vaccine developed by Moderna is a step closer to approval after early clinical trials proved successful, the pharmaceutical company reported this week.

The vaccine, called mRNA-1083, is one of several COVID-19/influenza vaccines currently in development, with pharmaceutical companies Pfizer and Novavax also conducting clinical trials with their own versions.

In a press release, Moderna said its combined phase 1 and 2 trials evaluated the safety and efficacy of their COVID/influenza vaccine when compared to:

a dose of influenza vaccine Fluarix for adults between 50 and 64 years of age
a dose of enhanced influenza vaccine, Fluzone HD, in adults 65 to 70 years of age
the Spikevax booster (Moderna's COVID-19 vaccine) for both age groups.

The vaccine was found safe, according to the company's statement, with only around four per cent of trial participants experiencing "grade three adverse reactions", which are "medically significant" but not life-threatening.

mRNA-1083 didn't cause any new reactions that weren't already linked to Flurarix, Fluzone or Spikevax, and provided similar or greater viral protection from influenza and COVID-19, according to Moderna.

The company says it plans to begin phase 3 trials soon in adults aged 50 and over, and is hoping for regulatory approval in the US in 2025.

Director of infectious diseases at Mater Health Services Paul Griffin said it was important to await peer review of the findings but early results appeared promising.

"Their combined mRNA vaccine had a similar safety profile and similar levels of efficacy [to current standalone vaccines], which is obviously very positive news."

He said when developing combination vaccines, it is important to ensure the protection offered by one vaccine isn't diminished by the other.

"This trial has established that's not the case, so it really paves the way for the combined vaccine to continue progressing."

Phase 3 will show vaccine effectiveness

Dr Griffin said early-stage clinical trials focused on safety and ensuring the vaccine generated sufficient levels of antibodies.

"But we can't say that absolutely translates into good levels of protection.

"That will need to be demonstrated in phase 3, which we expect to be the case."

Dr Griffin has been working on clinical trials of Novavax's combination COVID-19/influenza vaccine, and says phase 3 testing is underway after they too saw promising early results.

Novavax's vaccine differs to Moderna's and Pfizer's as it is protein-based, which means a form of a virus spike protein is injected into the body, leading to the production of antibodies.

Moderna and Pfizer are making mRNA vaccines. They use strands of genetic code to tell the body to construct spike proteins, which then elicit an immune response.

Adding RSV to the mix

Dr Griffin says because Pfizer, Moderna and Novavax have all demonstrated their COVID-19 vaccines are "adaptable" to a combination vaccine, he expects more COVID-19/influenza vaccines will be made by other pharmaceutical companies.

"They will be very impactful."

But he's most excited about a combination COVID-19/influenza/RSV vaccine, which he is also trialling with Novavax.

RSV — respiratory syncytial virus — is a common and highly contagious respiratory virus that usually causes mild, cold-like symptoms.

"We haven't had an RSV vaccine until very recently in some parts of the world," Dr Griffin said.

"Being able to combine all that into one vaccine is going to make a huge difference, I think."

There is one limitation with combination vaccines though — the viruses they cover don't necessarily peak at the same time of year.

"COVID is yet to become seasonal so the optimum timing of these combined vaccines is something that will have to be carefully thought through," Dr Griffin said.

"But, on balance, I think this limitation is outweighed by increasing the overall rate of uptake of these vaccines."

Combo vaccines will make getting vaccinated easier

Many Australians have fallen behind on their COVID-19 immunisations, according to the Australian Technical Advisory Group on Immunisation (ATAGI).

Last month, it reported only 53 per cent of people aged 65 years and older received a booster dose in the past six months.

ATAGI recommends that all adults aged 75 years and over should receive an additional booster if six months have passed since their most recent dose.

Dr Griffin believes combination vaccines will increase take-up as they mean one less trip to the GP or pharmacist.

"These combination vaccines will make it simpler and easier, and are certainly going to be something that helps people who are less keen on getting multiple injections."

He believes the earliest Australia will see COVID-19/influenza combination vaccines would be 2025, but this is dependent on successful outcomes in upcoming clinical trials.

In Slovakia, Health Minister Zuzana Dolinkova has resigned. She belongs to the "Voice of the President" party, the moderate force in the populist left-right government of Prime Minister Robert Fico .

Her resignation came after only eleven months in office. She justified it with differences of opinion over the budget, which provides for deep cuts in the health care system. However, the decisive factor was probably the report that the government commissioner for the investigation of the COVID pandemic , Peter Kotlar, presented a week ago.

In it, he not only questions the pandemic itself, but also calls for a ban on vaccination with mRNA vaccines developed by Western companies such as Biontech/Pfizer and Moderna. Experts disagree with him. In their view, these vaccines have helped to significantly reduce the number of deaths from the virus and the consequences of the pandemic.

Kotlar, a member of the ruling Slovak National Party, had spoken out against the then government's measures and the COVID vaccination on YouTube during the pandemic, for example, which earned him considerable popularity that helped him get into parliament.

Kotlar's call for a ban on mRNA vaccines has received support from Prime Minister Fico himself. "You all know that I personally have always been against vaccination with experimental vaccines against COVID," Fico said in his address to the nation published on Facebook at the weekend. He added that he had "many acquaintances" who had experienced significant health problems after the COVID vaccination . And he called on Kotlar to find out who in Slovakia had enriched themselves through the "unnecessary purchase of medical supplies and vaccines."

High mortality during the pandemic

Slovakia was among the hardest hit countries in the world in terms of the number of deaths related to the COVID pandemic. In this Central European EU member state of five million inhabitants, 21,000 people died as a result of COVID. In addition to a poor and underfunded healthcare system, disinformation campaigns , distrust of modern Western vaccines and the underestimation of COVID itself also contributed to this.

The mistrust led many Slovaks to reject Western vaccines and only wanted to be vaccinated with the Russian vaccine Sputnik . In spring 2021, then Prime Minister Igor Matovic sent a government delegation to Moscow to stock up on Sputnik. But after the EU did not recognize the Russian vaccine, it was ultimately not accepted in Slovakia either and the vaccine doses had to be destroyed.

No cooperation with the WHO

Nevertheless, the government of Prime Minister Robert Fico maintains its opposition to mRNA vaccines and its doubts about the pandemic. As a first step, it announced that it would end its cooperation with the World Health Organization (WHO) on the COVID issue.

"After all, at the time of the COVID epidemic, Fico was probably the highest-ranking leader of the anti-vaccination movement not only in Slovakia but in all of Europe."

"You cannot fight against unscientific facts," said Health Minister Dolinkova resignedly when she announced her resignation. "Mr Kotlar's ideas continue to find support in the government coalition, while they have no support in the world's scientific circles."

Before their use during the pandemic, the mRNA vaccines were subjected to rigorous testing by the European Medicines Agency (EMA). In 2023, the Nobel Prize in Medicine went to the two researchers Katalin Kariko and Drew Weissmann , who contributed to the development of corona vaccines with the discovery of mRNA technology .

The outrage in Slovakia over the government commissioner's report is correspondingly great. His conclusions are even described as wrong by the Slovak public media, which are increasingly under pressure from the government.

Oskar Dvorak, a member of the main opposition Progressive Slovakia party and deputy chairman of the parliamentary health committee, told reporters: "If we had a competition for uselessness, Peter Kotlar would win it. The commissioner for the investigation of the pandemic has no analyses, no evidence, but he is abusing his office to spread dangerous disinformation."

In his article, Sagripanti dives right into concerning revelations:

“Responding to these questions resulted in unexpected findings regarding the effectiveness of lockdowns and curfews, use of face masks, mandating social distancing and ordering massive vaccination campaigns.”

Among the key details from Dr. Sagripanti is the shocking admission about what led to the general public being locked down and forced to vaccinate.

The unusually restrictive measures were mandated largely in response to predictions made by computer modeling of the pandemic, Sagripanti reveals.

The WHO’s system linked to the “prestigious Imperial College of London, projected that without drastic intervention (like lockdowns and quarantines), 7 billion infections worldwide and 40 million deaths during 2020 alone,” Dr. Sagripanti reveals.

This admission raises a lot of serious questions.

In fact, he refers to the response as a “blunder.”

Dr. Sagripanti explains that depending on computer predictions from the United Nations “health” agency led to “catastrophic global consequences.”

He cited a “stational progression of the pandemic.”

Sagripanti continues by explaining a massive failure of countermeasure response caused the majority of deaths during the pandemic and not the virus.

The failures included pushing mandates for ineffective “vaccines,” ordering lockdowns, and intriguing hospital protocols that killed patients instead of helping them.

He also referred to ironically, the “lower mortality registered in developing countries in comparison to developed countries where more hospital beds and respirators were employed.”

Sagripanti’s bombshell conclusion is the following statement:

“Hospital infections resulting from intensive medical intervention and not SARS-CoV-2 could have accounted for the majority of deaths among patients otherwise healthy and without compounding health conditions.”

The last sentence summarizes what represents a profound point for contemplation.

The news comes after the Canadian government was forced to admit that its vaccination campaign caused deaths to surge.

As reported earlier, the damning admission was revealed in previously hidden data that lawmakers compelled that nation’s top federal health agency to hand over.

A parliamentary inquiry ordered the Public Health Agency of Canada (PHAC) to unseal and surrender data for the country’s death rates during the pandemic.

The data revealed that deaths increased for every dose of Covid mRNA shot that was pushed onto the public.

The timing is interesting of finally dropping the covid shot mandates because the VP of Costa Rica Mary Munive, who is also the Health Minister, was hearing an earful from Interest of Justice on the illegality of covid “vaccines”. We are asking for a private hearing due to how sensitive the issue is. Next thing, while awaiting our answer, we hear she dropped the covid vaccine Mandates.

Mary Munive really, really loves vaccines, and is now promoting a 100% injection rate of all “normal” vaccines as requested by WHO/PAHO 2 months ago, so this is interesting.

Rodrigo Chaves' government repealed the mandatory nature of the Covid-19 vaccine for the entire population by decree 44559-S on July 17, 2024, which repeals article 2 of decree 42889-S and its reforms, including its mandatory nature for children.

Look, this isn’t Costa Rica’s first Rodeo dropping the mandates. The President stood side by side to the Health Minister and said so long ago on August 4th, 2022 that “the commissions like to push for unusual things in our country” and “they want us to be like these other countries that do not respect peoples freedom to choose”. (listing Ecuador, Vatican and naming other wrongdoer mandating countries, allegedly not wanting to join their wrongdoing). The President said on that day that the covid vaccine mandates were dropped and we went so far as to say “Costa Rica’s people are not like cattle that you beat with a stick and force to get vaccinated”.

From 2022 - President and former Health Minister making covid vaccine mandates illegal - this was in 2022, but not actually solved until now. Thank goodness it’s over:

Unfortunately the President has little power and the Vaccine Commission won by reinstating the mandates about 2 weeks after. We think that Canada’s Trudeau visited Costa Rica on Vacation to put on the Young Global Leaders type of pressure. We presume there were some talks among leaders and Chaves was told to get in line. Chaves has not spoken out against vaccines since…. Until now.

The mandates are over but there is still current interest in our contentious process that is ordered by the Appeal court November 9, 2023 in our Nuremberg Code case. We challenge the issue of the inclusion of the disease covid-19 (and covid-19 vaccine) in the universal basic public scheme of Costa Rica (article 1 of the same decree), which we contend is totally illegal and constitutes an attack with biological agents known to cause harm, and administered without informed consent of that harm, a crime against humanity.

Below is from the decree dropping the Mandates and the reason is so lame:

8.- That in the ordinary session No. 11 of June 27, 2024, the National Commission of Vaccination and Epidemiology agreed that "Given the current conditions cited by the Directorate of Health Surveillance, by way of office N subparagraph MS-CNVE-106-2024, in relation to the behavior of the COVID-19 disease and its variants in the whole population, and the document of the World Health Organization (of 17 June 2024), this Commission considers it appropriate to withdraw what concerns the vaccination against COVID-19 indicated in Executive Decree N 43971 of 27 March 2023."
9.- That by virtue of the fact that Executive Decree N subparagraph 42889-S of 10 March 2021 of repeated appointment was promulgated because of the health situation caused by the COVID-19 disease, which has ceased, it is considered that this Executive Decree should not be submitted to the process of public consultation because it does not fall within the cases referred to in article 361 of Law N 6227 of 2 May 1978 "General Law on Public Administration," as it consists of a derogation.

Costa Rica VP & Health Minister Mary is the same bad ass who told WHO to shove it on the pandemic treaty - But her reason was because the pandemic treaty process itself is so contentious that now no one trusts them all and its hurting vaccine uptake…

Well, at least Costa Rica isn’t forcing the damn biological agents into their children, government and health workers arms any longer… All was without informed consent and all was unnecessary.

It breaks our hearts and is why we are working so hard to finish the main case and criminal case, which are about a month or two from filing - IF we can get it funded!

There was an unexpected bill yesterday, leaving us with almost nothing, which is understandably freaking us out when we still owe the Attorney $7500 now, and also monthly payments until we are paid up which is going way too slow. Dr. Yeadon even asked for donations a few days ago and NONE came in. We were trying to stay lighthearted and laughing that not even Dr. Yeadon can call in funding for this case. SIGH!

At the same time we are buried in stressful legal work (not getting paid which is fine) as we are the sole Paralegals who know the facts to train the Attorneys on the case. The stress of financially taking on both the full time work and also taking on the debt for humanities best shot case and almost having to give up on IOJ due to no steady funding is leaving us saddened at the lack of support from a wider base of readers and cheerleaders. We believe more people could support but they want to see results. Results cant be promised, but the work to try the best for humanity to have a fighting chance can be promised, but only with real resources to do the job!

We honestly think we can win with Dr. Yeadon, Sasha Latypova and the team of bad ass witnesses to prove its all part of a crime and always was an illegal WHO declaration of emergency based on PCR false diagnostics to push out the deadly non vaccines. The case is pretty close to complete but a ton of work.

IoJ filed another precautionary measure on Thursday, which has quickly been assigned to the President of the Constitutional Chamber of The Supreme Court of Costa Rica.

IOJ’s latest attempt at an injunction to stop covid [non] vaccines is based on the experimental nature of the COVID-19 Non “vaccine”.

Another injunction is also being filed this weekend, which we are still finishing, to cover all bases based on the problem of SV40, DNA integration and the shots potentially irreversibly affecting the human genome into the future.

Why now?

Just recently, we received back the report from the criminal prosecutor, informing us that we were correct in our presumption that the Health Minister lied in many of our cases that we filed in the Constitutional Chamber between the years 2020 and 2022.

Now we are simply returning, once again, to the Supreme Chamber, in the resolute spirit of persistence, to reiterate & notify them that they need to fix their injustices they allowed in the record.
When we first presented the cases, over and over, the court insisted repeatedly that they were only able to take the Ministers oaths at face value (as if his testimony is true because it is under oath) from the State until proven.

We FINALLY got the proof from the Attorney General to correct the record - it only took 3 years!!!

The Attorney General concluded the Health Minister is a damn liar under oath and absolutely gave false statements to the court in 7 of our cases.

So there you go. We got the proof we need to return to the court to FINALLY determine the truth:

Truth: that the Health Ministers dubious testimony, “covid vaccines are NOT experimental”, is based on the lie under oath they are “fully approved”, which the lie first occurred in this top court to the top judges.

These top judges then mandated themselves to get the safe non experimental “vaccine”…

The Judges will be so mad to learn they were duped and forced to take experiments they were told were safe vaccines and necessary by the Health Minister.

IOJ’s key functions are to help the Global Community of Citizens ensure government accountability to the people. Petitioners request that PRECAUTIONARY MEASURE be issued, in accordance with articles 41, and 48 of the Political Constitution. The precautionary measures can also be issued under Biomedical Research law 9234 ARTICLE 71.- Precautionary measures - During the processing of administrative procedures or investigations in court that question the legality of the activity of the investigator, the sponsor or the CEC, the OIC or the OAC and for the purpose of safeguarding the health and safety of the participants in an investigation , the competent body may impose the necessary precautionary measures. The investigations, the investigator or the approval of research projects may be temporarily or permanently, partially or totally suspended in the event that the administrative authority or the judicial authority considers it necessary. The competent body, through a well-founded resolution and after hearing the interested parties, must resolve whether to confirm, modify or revoke the measure adopted. To do this, you must apply the procedure established by the Contentious-Administrative Procedure Code.

This Amparo can also be considered a class action to protect the health and safety of the entire population of Costa Rica which are being subjected to Phase III investigational products which are properly regulated under the bio-medical research laws 9234 and 39061-s which has a higher level of informed consent than an approved vaccine.

It os imperative for this court to take judicial recognition that the health Minister has contradicted themselves by indicating under oath 2 contradictory statements, 1. The COVID-19 “Vaccine” is not experimental and 2. The COVID-19 “Vaccine” is imported as investigational and a biomedical research product regulated under 9234 for which expressly defines investigational products as being ther same as experimental products which are NOT yet fully approved. Whilst not being approved, there is no way for the State to ensure the short or long term safety of the investigational product which was imported under article 117 which only allows investigational products to be imported so long as 2 conditions are met. A) the investigational product can be imported for the exclusive purpose of human research (research is experimentation), and B) the investigational product can be imported as long as it is in compliance with applicable laws, which it is not in compliance with Siracusa Principles article 69(b) and articles 1-10 of the Nuremberg code. The higher law is to protect the human rights, welfare and safety of the participants of biomedical research and the precautionary measure must be issued in order to ensure the protection of the health and safety of the population in order to ensure there is no further iatrogenic harm caused and no further repeatability of the loss of the debial of peoples rights to be free of scientific and medical experimentation. Plaintiffs remind the court that under the Siracusa Principles which are signed by Costa Rica the right to be free of scientific and medical experimentation os non derogable. The State has no right to continue to deny this right and subject the population to risky unproven interventions which are not fully approved.

First, The prosecutor is not efficient and is wholly inactive which affects our rights and affects the public interest as well.

Beginning in August 2021 the Sala 4 sent us 3 x to report the Health Minister lied under oath in this chamber and give it to the prosecutor, who does in fact confirm that Daniel Salas gave false statements under oath in 6 of our cases. (Please see attached evidence from the prosecutors office)

Problem: Once again we return to this court for protection, reiterating the truth that the non vaccines falsely called covid vaccines are not approved, still experimental, which this court knows is true, but outrageously allows the Administrations false testimony to be ratified, so this court can continue to pretend the covid vaccine experiments are approved.

CONIS, the regulator in CR has given the same lie in a report on March 27, 2023, meaning the law to protect humans in biomedical research is not being applied at all, under the lie that covid vaccines are approved and no longer experimental.

To be clear the Administration testifies covid vaccines are imported under Article 117 as investigational, a word meaning experimental.

Attached are registered experiments with assigned investigators for interventional studies on the dangers of Pfizer vaccines. Mengele at least was honest he was experimenting, and we are very injured that Costa Rica, our domicile of choice, has gone the way of Nazi Germany, but worse.

Sala 4 allowed 3+ years to continue the experiments and send us to the prosecutor over and over. Sala 4 is so shameful. In our opinion, Sala 4 had to know the prosecutor is too slow because the former President of the Sala said so on TV that the prosecutor is too slow. We think it is pretty obvious that the prosecutor is biased and would never prosecute the false testimony, the prosecutor agrees the Health Minister lied in 7 cases, about the safety and approvals of the covid [non]vaccines but also is trying dismiss the case for frivolous void reasons.

Despite the national significance of the lies being in violation of the Constitution Article 46 right to adequate and truthful information, as well as breaching jus cogens norms for violating the non derogable right to be free of medical experimentation protected under Article 62b of Siracusa Principles, we are shocked the inactive prosecutor wants to dismiss the case and will not prosecute the crimes of former Health Minister Daniel Salas false testimony that took place in Sala 4 which left false testimony affecting the non derogable rights of thousands of people who were forced or misled into an unapproved intervention which is not yet a vaccine by law, and was imported as investigational under article 117.

The criminal court has apparently archived the case proving Daniel Salas lied under oath, which we consider false testimony, the prosecutor archived the case when the court was supposed to be transferring to the correct jurisdiction, and we have not had due process.

Sala 4 sending us to the inactive prosecutor, and not issuing precaution while we find out if the injections are really experiments, is the only thing allowing and continuing the experiments unabated in CR for years.

The prosecutor Sala 4 unfairly sent us to, in order determine truth from fiction on the record, concludes Daniel Salas indeed did lie, just like we warned Sala 4 years ago many times. But instead of do the job of a court and make just rulings to protect peoples rights, Sala 4 instead decided to ratify Administrative lies, fiction, disinformation, deception, which is still allowing serious undue experimentation on the whole country, lying to millions of trusting people that the vaccine is safe and no longer an experiment, a total lie.

Sala 4 and the prosecutors inactivity, inefficiency and errors in ruling against us so many times is literally allowing a widespread and systematic codified crime under 9234 Articles 78, 79 of serious undue experimentation through disinformation, deception, manipulation, coercion, threat and other illicit means of false testimony!

We are injured by the serious delay in the administration of justice, but so are many thousands, if not millions of people as well as the State of CR is injured. The public interest and morality is harmed. The Administration is wholly corrupt, not functional, inactive in the face of life threatening situations and a bunch of unscientific liars, many with unabated conflicts of interest.

We are really sick and tired of being sent in circles and justice owed to us and the country delayed for many years. This court has a duty to stop the experiments called covid vaccines TODAY.

The administrative delay constitutes an injury to a fundamental procedural guarantee and the Sala 4 has caused the injury by putting the Administration above people and truth, and refusing to do their job of interposition, of discerning truth from fiction, and it was Sala 4 who decided to allow demonstrably false testimony on their own record, destroying justice in Costa Rica at the hands of the Administration who lied under oath about the approval, which never existed for the experimental covid vaccines gene therapy.

It’s not a vaccine, that’s more false testimony. It is gene therapy, which is transcribing DNA, causing mass harm and injury and which has an unreasonable risk if used in mass outside clinical trials, as is occurring in CR.

We require protection for a change rather than send us away again injured with no remedy for something so serious.

Our mission is to hold governments to account. We are returning to Sala 4 again, after far too many attempts at justice, in order to complete our mission of justice for humanity and to get the court to do the right ruling this time, and issue precaution and suspend the covid vaccines and all imports.

Our organization helps to protects the vulnerable groups affected by the acts of false testimony.

We also aim to helps protect the judiciary, in order to help protect it from corruption and fraud on the court, which was obviously intended to impede the judicial machinery itself.

We ask the court to issue the Amparo precautionary measure to stop the experimental covid vaccines from being further applied.

We also request the court to issue protection of our right to prosecute Daniel Salas and CONIS members for the false testimony they both made where they both falsely testified BioNTech is approved and had ethics boards in compliance with int norms.

The only judge who ever got it right is Magistrate Cruz.

We thank him for staying in honor and for being correct. We have been denied prompt and fulfilled justice, quite obviously. Even the blind could see we were right and this court erred many times by refusing to consider Daniel Salas false testimony we proved before a few rulings. We are injured, we need this courts help to protect our right to prompt justice because the administrative delay constitutes an injury to a fundamental procedural guarantee owed us long ago.

[SIDE NOTE TO READERS: The following quote is from the only Judge that stood up for us and didn’t want this case kicked out to the Administrative Contentious court - his quote standing up for us in a previous case, posted below, explains these DELAYS are injuring us, and he totally schools the court. His statement below to the court ROCKS!]

In the case he was referring to below, we were filing the case with a BABY named to protect from school mandates, and they threw us out to the expensive Administrative Contentious court where you MUST have a specialized attorney and they need to be paid.

IV.- SAVED VOTE MAGISTRATE CRUZ CASTRO. Although in the past I have sustained the majority criterion of the Court, under a better weighing of the fundamental rights that are claimed, I consider that the administrative delay constitutes an injury to a fundamental procedural guarantee, reason for which I change the criterion that I had exposed, admitting the possible infringement to the right to a prompt and fulfilled administrative justice, separating myself from the vision of the majority of the Court, in the sense that -with few exceptions- this type of reproaches must be resolved in the administrative contentious jurisdiction. On the contrary, I believe that one of the rights that this jurisdiction is called upon to protect is the right to prompt and complete justice, expressly enshrined in Article 41 of the Constitution. This is in accordance with the scope of competence assigned to this Court in matters of protection of fundamental rights, in accordance with the provisions of Articles 10 and 48 of the Constitution. Although I understand the importance of the reforms of the contentious-administrative jurisdiction since the enactment of Law 8508 of April twenty-fourth, two thousand six, the truth is that such situation does not justify the referral to such instance of the matters that deal with matters within the competence of this Chamber, which has demonstrated over the years that it is a fast and effective means for the protection of the fundamental rights of the inhabitants of the country.

In Conclusion:

Sala 4 has the duty to issue the injunction to suspend all application of the COVID vaccines and further imports until the time that the product is fully approved and passes ample safety mechanisms.

The truth is this case should not be sent to the ordinary court because the crime of false testimony and the false rulings came from this court who has the duty to correct their pwn incorrect rulings that were based on lies. Also, We have hired a very expensive attorney who is drafting the ordinary case and says it will take a few more months because of the extensive amount of facts in which we need to present. We have gone to the ordinary court many times and they have lost our cases for over 10 months and also is asking us to restart our case and file a main case to get to the bottom of all of this. We are being forced to change our lifestyle into full time fund raisers and are still very short of the lawyers fees for this ordinary case which is $85,000.00 quoted from every lawyer because the case is so much work for an attorney. We think the State should be paying the lawyer and that it's very unfair to put all of this burden on to us, which causes us enormous damages. The situation is far too urgent considering the manifest illegality of the act of serious undue experimentation with no informed consent based on repeated false testimony from Costa Rica's public officials. The State is responsible for cessation and reparations.

What we are asking for is this court to issue a precautionary measure to protect the health and safety of the people being experimented upon by suspending the experimental COVID-19 non "vaccines" from use and import until we can resolve things fully in the criminal and administrative courts.

We are also asking this court to issue a secondary order, to command the prosecutor to not dismiss the case against Daniel Salas for the reasons stated that Daniel Salas may not have known what he signed and therefore may not be culpable. The prosecutors stance ignored the Constitution art, 11 which public officials must be personally responsible. Daniel Salas was the health minister, and therefore had personal responsibility to know the truth of his personal statements in court under oath. In reality, Sala 4 ordered Salas to answer under oath because Daniel Salas was the only one with first hand knowledge as stated in our record. It is very unfair to leave this type of false testimony about this experimentation on the Sala 4 record, which keeps being used against us, and also the people of Costa Rica being experimented upon, to keep the lies and criminal application of COVID-19 circulating under the guise that it’s not experimental, which is false.

It is imperative to note that the regulator CONIS is relying on the Sala 4 rulings that say it is not experimental for them to breach their duty and not regulate the bio medical research product COVID-19 non "vaccine" whatsoever. Because the rulings that CONIS relies on were based on the false testimony of Daniel Salas et al, it seems the entire country is being subjected to an experimental cohort that is not adequately tested past 3rd phase and is therefore manifestly illegal under the laws of Costa Rica because the country is experimenting on people with products not proven to be safe, whilst lying to the public and Sala 4 that these are safe and approved vaccines.

The law and Siracusa Principles 69b does not allow this experimentation to continue and therefore we invoke the duty of the Constitutional chamber 4 to IMMEDIATELY issue the requested precautionary measure, which will have the effect of suspending the manifestly illegal act of scientific and medical experimentation with no informed consent on the entire population.

It is Sala 4's duty to protect the rights of the people and to protect rule of law that prohibits serious undue experimentation, and if the precautionary measure were to be denied, then rule of law has died in Costa Rica. Sala 4, we beg you to do the right thing and restore rule of law in the Republic which has been thwarted for years by the Administration.

The constitutional jurisdiction Article 1 requires the enforcement and application of Siracusa Principles Article 69b and Articles 1-10 of Nuremberg Code, which are not being enforced due to these false rulings in Sala 4.

Sala 4 sent us to the prosecutor to find out if Health Minister Daniel Salas testimony was true or false. The prosecutor says its FALSE, but does not want to prosecute based on frivolous reasons that contradict his duty and law. What now?

Our right to truthful and adequate information, right to prompt justice, and right to a an efficient administration, as well as the right to prosecute is being affected and we wish to have remedy immediately because the entire countries right to informed consent and to be free of medical or scientific experimentation is being wholly denied in error based on lies of the Administration and due to fraud on Sala 4 court, intended to impede the judicial machinery itself.

Prosecutors reply to our complaint proving Daniel Salas lied to the Chamber
January 24, 2022 confession from the Ministry of health and the CNVE vaccination commission the product is still investigational which is a word that means experimental under the biomedical research law of Costa Rica 9234
Proof of 12 registered studies (experiments) in CONIS (Costa Rica’s regulator) with investigators assigned to each study, who are investigating the effects of covid vaccines, including one studying the adverse effects of the Pfizer covid vaccines in health workers who were mandated to be part of the interventional study!

Proof of the REGISTERED EXPERIMENTS:

(they had to be registered upon import as INVESTIGATIONAL products must be registered with an assigned INVESTIGATOR) - It’s in Spanish, and says they are interventional and observational studies for covid vaccines. One of these registered experiments is to study adverse effects in Pfizer BioNTech!!! But the court ruled its NOT an experiment? Come on! This is just crazy. It took a while to hunt down this proof by the way, since they hide everything!

Remedy requested:

Permanently and totally suspend approval of research projects for covid 19 vaccines, which may be temporarily or permanently, partially or totally suspended in the event that the administrative authority or the judicial authority considers it necessary.
Stop the use and imports of all covid vaccines in the republic under 117 which allows imports of unregulated products including covid-19 vaccines
Suspend covid vaccine in immunization schedule law - covid vaccines are still experimental and not approved!
Publicly retract all Sala 4 false rulings that falsely indicate the covid-19 vaccine is "not experimental", due to the Daniel Salas et al fraud on the court, where Sala 4 has shockingly verified the repeated false statements of the Administrations public officials under oath in Sala 4 rulings, and Sala 4 falsely verified to thousands of victims of serious undue experimentation it was legal to force inject them with an untested and unsafe experimental product, covid-19 vaccine, which never made it to 4th phase approval to become a vaccine. It is in pre-vaccine and pre-approval phase at this point in time and the Sala 4 rulings directly contradict jus cogens norms enshrined in Siracusa Principles Article 69b, allowing the manifestly illegal act of serious undue experimentation on most of the population. A lot of those victims were destroyed and denied rights to be free of medical experimentation, because many thousands of people came to Sala 4 to protect the right which this court illegally denied them, based on the Salas, et al Administrations repeated and systemic fraud on the court.
Sala 4 shall order the Minister of Health to issue a public apology for the invalid rulings which violated peoples rights
Order the prosecutor to prosecute - Make an order indicating the prosecutors reason to dismiss is insufficient. Cruzas case and dismissal violates Art 11 personal responsibility in the Constitution, because mandatory personal responsibility is highest law.
The State should be ordered to pay for our estimated legal bills of $85,000 up front, immediately, which is needed so the injured plaintiff can pay for and hire the attorney team for the Ordinary cases that will be needed due to the States excessive delays and denials of justice over the past 3 years and also damages should be ordered for compensation due to the burdens upon the plaintiff by the States errors.
